Terms of service

Last updated October 27, 2026

These Terms are an agreement between you and TendSphere, a software service operated by Tanner Braun in Clear Lake, Iowa ("TendSphere," "we," or "us"). By creating an account, subscribing, or using TendSphere, you agree to these Terms and our Privacy Policy. TendSphere is for real-estate business use, not personal or household use. If you have questions, email hello@tendsphere.com.

What TendSphere does

TendSphere is a web app with a follow-up board that helps real-estate agents see which contacts to follow up with and when. You bring in your contacts from Mesh, an uploaded contacts file, or by entering them yourself. If you connect Google Calendar, TendSphere can read calendar events to support your board. It will move an event only if you turn on "Can change" and move the event on your board; it changes only the event's start and end times.

TendSphere does not text, call, or email your clients. You contact them yourself, using your own phone and accounts. The board is a tool to help you manage follow-ups; it does not replace your judgment or professional responsibilities.

Your account

You sign in with Google. You may have one account per person and must not share your account. You must be at least 18 and use TendSphere for your real-estate business.

You are responsible for keeping your account and sign-in details secure and for activity under your account. Tell us promptly if you believe someone has accessed your account without permission.

Subscription, payment, renewal, and cancellation

TendSphere is a monthly or yearly subscription at the prices on the pricing page and shown at checkout. Applicable taxes may be added at checkout unless the price is expressly shown as tax-inclusive. Your subscription is paid by card through Stripe. We do not see or store your card details; Stripe processes payments under its own terms.

By subscribing, you authorize recurring charges to your payment method at the price shown when you sign up, plus applicable taxes. Your subscription renews automatically each month or each year, as applicable, at the then-current price until you cancel.

You can cancel at any time in Account → Billing. Cancellation takes effect at the end of the paid period, and you can keep using your board until then. We do not refund unused time, except where the law requires a refund. Before each yearly renewal, we will email a renewal reminder to the address on your account.

If a payment fails, Stripe may retry it, and your board stays open while it does. If payment still cannot be collected, your subscription ends and your board is paused until you start your subscription again; it will not be deleted just because payment failed.

We will give you at least 30 days' notice before a price change. The new price applies at your next renewal. If you do not agree, you can cancel before that renewal and will not be charged the new price.

You are responsible for taxes that apply to your use of TendSphere and that we are not required to collect from you. We are responsible for taxes on our income.

Your data and your clients' data

You own the information you add to your board, including your contacts, notes, and follow-up information. Your clients' information remains yours to manage; these Terms do not transfer ownership of it to TendSphere.

You give TendSphere permission to host, store, process, display, back up, and otherwise use your data as needed to provide, secure, and support the service for you. We handle personal information as described in our Privacy Policy.

Your board may include your clients' names, phone numbers, email addresses, birthdays, and notes. You are responsible for having the rights, permissions, and any notices or consents needed to put that information into TendSphere and for using it lawfully. This includes following rules that apply to your communications and real-estate business, such as consent requirements for calls and texts, do-not-call requirements, fair-housing rules, and state advertising rules. TendSphere does not contact your clients for you.

You can export your board data at any time from your account. If you ask us to delete your account, we will delete your board within 30 days. Deleted data will drop out of encrypted backups within a further 45 days. Some records may be retained where required by law or needed to resolve a dispute or protect our rights.

Apps and services you connect

Google, Mesh, Stripe, Resend, Discord, Contabo, Backblaze, and Cloudflare are separate services and are subject to their own terms and policies. Discord carries the owner's own payment, sign-up and feedback alerts only: an agent's first name and last initial, for payments their plan and the amount, and for feedback the words of the note they sent; never their contacts or anything else from their board. UptimeRobot performs uptime checks only and does not receive your personal data. We are not responsible for third-party services, their terms, or their availability, except to the extent these Terms or applicable law make us responsible.

You connect Google Calendar and Mesh using your own accounts. Mesh changes and Google Calendar access depend on the permissions you grant. You can disconnect a connector at any time. If a third-party service changes or stops working, features that rely on it may stop working too.

Google user data is handled under the Google API Services User Data Policy, including its Limited Use requirements. Payments are processed by Stripe under Stripe's terms.

You can connect your own AI assistant (such as Claude or ChatGPT) to your board. You choose to connect it, and you are responsible for that assistant, your account with its provider, and what you ask it to do. Information it reads from your board, including your clients' information, is handled by that provider under its own terms. Check that using it fits your obligations to your clients and your brokerage. Its answers can be wrong, so check anything before you rely on it or send it. We are not responsible for an assistant's answers or its provider's handling of information.

Fair use

You must not use TendSphere to break the law, send spam, store information you have no right to store, or access anyone else's data. You must not try to hack, overload, disrupt, or reverse-engineer TendSphere, or interfere with another person's use of it.

We may pause or close an account that violates these Terms. Where practical, we will tell you what happened and why before taking action.

Keeping TendSphere running

We back up changes within seconds and keep nightly copies. Backups are encrypted, stored with Backblaze, and kept for up to 45 days. Your board data is encrypted per agent on a Contabo server in the central United States.

We work to keep TendSphere available, but we do not promise uninterrupted service, error-free operation, or that the board will always identify the right person or time for a follow-up. Your judgment remains the final word in your business. If a security incident affects your data, we will notify you as required by applicable law.

Warranty disclaimer

To the extent the law allows, TendSphere is provided "as is" and "as available." We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Nothing in these Terms excludes a warranty or right that the law does not allow us to exclude.

Ownership of TendSphere

TendSphere owns the app, its design, its content, and its trademarks, except for your data and third-party materials. While your subscription is active and you follow these Terms, we give you a limited, non-exclusive, non-transferable license to use TendSphere for your real-estate business. You may not sell, sublicense, or transfer that license.

Suspension and termination

You can stop using TendSphere and cancel your subscription at any time through Account → Billing. We may suspend or end your account if you breach these Terms, including the fair-use rules. Where practical, we will give you notice and explain the reason. If your account is suspended or ended, you may still export your data where reasonably possible and permitted by law.

If we ever close TendSphere, we will give you at least 60 days' notice and time to download your data.

Indemnity

To the extent the law allows, you will defend and indemnify TendSphere, Tanner Braun, and our service providers against third-party claims, losses, and reasonable legal fees arising from your use of TendSphere, the data you store on it, or how you contact your clients. This includes claims related to your lack of rights or consent, calls or texts (including TCPA or do-not-call claims), or fair-housing or advertising practices.

To the extent the law allows, TendSphere will defend and indemnify you against a third-party claim that the app, as we provided it, infringes a U.S. intellectual-property right, or a claim directly caused by our gross negligence or willful misconduct. This does not cover claims caused by your data, changes you make, or use of the app contrary to these Terms.

The party asking for indemnity must promptly tell the other about the claim and reasonably cooperate. The party providing indemnity may control the defense and settlement, but may not settle a claim in a way that admits fault for, or imposes a non-monetary obligation on, the other party without that party's agreement. These responsibilities are subject to the limits below to the extent the law allows.

Limits on liability

To the extent the law allows, neither side is liable to the other for indirect, incidental, special, or consequential damages, or for lost profits, lost commissions, or lost leads, arising from TendSphere or these Terms.

To the extent the law allows, each side's total liability for all claims related to TendSphere or these Terms is limited to the amount you paid TendSphere in the 12 months before the event giving rise to the claim.

These limits do not apply to liability that the law does not allow to be limited, including gross negligence or willful misconduct where applicable. They do not change who owns your data or your clients' information.

Disputes

Iowa law governs these Terms, without regard to conflict-of-law rules. Before filing a lawsuit, both sides agree to try to resolve the dispute by emailing hello@tendsphere.com and allowing 30 days for a resolution attempt.

If the dispute is not resolved, it must be brought individually in the state courts located in Cerro Gordo County, Iowa, or, if federal jurisdiction exists, in the United States District Court for the Northern District of Iowa. Either side may bring an eligible individual claim in small-claims court where you live, if that court has jurisdiction and applicable law permits.

To the extent the law allows, disputes must be brought on an individual basis, not as a class action, collective action, or representative action.

Electronic communications and signatures

By using TendSphere, you agree that we may send you notices and other communications electronically, by email or in the app. You agree that electronic records and signatures, including your online acceptance of these Terms, are valid and satisfy legal requirements for written records and signatures under the federal E-SIGN Act and applicable law.

We may email you account, billing, security, and other service notices. We may also send morning follow-up lists, Sunday summaries, and replies to your feedback through Resend. You can turn off optional follow-up and summary emails, but you cannot opt out of essential account, billing, legal, or service notices while your account is active. Keep the email address on your account current.

Changes to these Terms

For material changes, we will email you at least 30 days before they take effect. If you do not agree, you can cancel before your next renewal and will not be charged for a later renewal. Continuing to use TendSphere after the changes take effect, or not cancelling before your next renewal, means you accept the changes.

Other terms

These Terms and our Privacy Policy are the whole agreement between you and TendSphere about your use of the service. If one part cannot be enforced, the rest remains in effect. If we do not enforce a term right away, that does not mean we give it up.

We may transfer these Terms as part of a sale, merger, or transfer of TendSphere or its business. You may not transfer your account or rights under these Terms without our written permission.

Terms that should continue after your account ends, including the provisions on liability, indemnity, disputes, and data deletion, will continue to apply.

Neither side is responsible for a delay or failure caused by events beyond its reasonable control, such as a natural disaster, war, or widespread internet or power outage.
